Former pilot accused of murder shares his version of events

Former Jetstar pilot Greg Lynn has shared his version of events from the day Russell Hill and Carol Clay were allegedly murdered.

Mr Lynn, who is on trial for the murders of the elderly campers, claimed Mr Hill, 74, knifed himself in a struggle after he accidentally shot his childhood sweetheart Ms Clay, 73, in the head.

Police allege Mr Hill and Ms Clay were murdered while camping in the remote Wonnangatta Valley in Victoria's Alpine region more than four years ago, with Crown prosecutor Daniel Porceddu telling the jury at the opening of the trial exactly how and why Lynn allegedly killed the couple.

"The precise circumstances of the killing are unknown, nor is the motivation," he said.

The jury heard it was most likely a dispute over the use Mr Hill's drone, as Mr Porceddu said, "There might have been an argument or confrontation between the men. It is not known how Mr Hill was killed."

But in providing a brief defence, Lynn's barrister Dermot Dann KC, claimed Mr Hill and Ms Clay's death was the result of a tragic accident, telling the jury, "We say not a case of murder, this is a case of two accidental, tragic deaths."

"Tragic accidental deaths in circumstances that were not of Mr Lynn's making and not of his choosing."

Mr Dann told the jury that Mr Hill allegedly stole Lynn's shotgun after he became enraged about Lynn playing loud music on the night he was killed.

The barrister then detailed how a fight over the gun ensued, which resulted in Mr Hill accidentally shooting Ms Clay in the head, as Mr Lynn tried to disarm him.

Mr Dann said Lynn picked up the gun and fired its remaining ammunition into the air before being set upon by an enraged Mr Hill.

"The next thing is Mr Hill's advancing towards him with a knife screaming at him 'she's dead'," Mr Dann said.

"A struggle developed over the knife. Mr Lynn trying to defend himself - they're locked in this struggle - and as part of that struggle the two men fall to the ground and the knife goes through the chest of Mr Hill."

Upon his arrest, Mr Dann claimed Lynn co-operated with detectives, telling them where to find the bodies of the campers, and once again telling the jury that Mr Lynn is not guilty of murder or manslaughter.

Groom’s tragic update after bride killed on wedding day

A US man whose bride died on their wedding day after an alleged drunk driver rear-ended their golf cart is recovering at home and planning his wife’s funeral, his family revealed.

Aric Hutchinson, from South Carolina, suffered severe injuries, leaving him with bleeding in his brain, two broken legs, facial fractures and a broken vertebrae in his back, according to a post on GoFundMe, written by his mother, Annette Hutchinson.

The 36-year-old and his new wife, Samantha Miller, 34, had just left their wedding reception when the accused drunk driver Jamie Komoroski crashed her car into the golf cart the newlyweds were riding on. Ms Miller sadly died instantly. Two family members on the same golf cart suffered injuries.

Ms Hutchinson shared that her son is now “physically recovering at home while trying to come to terms with the loss of his beautiful wife. Now he is doing the unimaginable of planning Sam’s funeral along with her family”.

“We are missing Sam more than anything. She instantly fit into our family from the first day Aric and Sam met. She was everything to my son and changed him for the better,” she continued.

“She could light up a room with her presence and had an ease about her. They shared many hopes and dreams for their future, including children and building a house.

“What started as the happiest day for Aric and Sam ended with a tragedy … our hearts are broken along with the Millers’.”

Ms Komoroski has been jailed without bond, and charged with three counts of driving under the influence causing death and reckless vehicular homicide. Authorities claimed the 25-year-old was driving at 104km/h in a 40km/h zone and reportedly only hit the breaks of her Toyota Camry right before the crash.

Ms Komoroski told police she had consumed a tequila shot and one beer an hour prior, but refused to take a field sobriety test following the collision. A blood test was later conducted at a hospital, the results of which have not been released.

In a statement to Fox News, Ms Komoroski's lawyers urged the public not to “rush to judgement”.

Ms Miller’s mother Lisa revealed her heartbreaking final exchange with her beloved daughter.

Speaking to WCIV, Lisa Miller said that “on the beginning of the golf car ride, [Samantha] said, ‘I wish this night could go on forever.’”

“[It was] the best night of her life,” she added.

Ms Miller said she was unaware of “what the distraction was” that caused the accident, but Ms Komoroski “literally ran into my daughter going 65 miles an hour”.

“Sammie and Aric were on the back of the golf cart and so she basically just whammed into my child.”

The bride’s sister, Mandi Jenkins, told WCIV, “That person made a careless mistake. And it’s not a mistake. It is a life-changing event,”

“I never thought it would happen to us and to my beautiful sister, your beautiful daughter and all the 150 people that were there.”

Paul ‘Dusty’ Miller, veteran and beloved father of five, has passed away of a suspected heart attack while walking the Kokoka Track.

Paul, who had joined the Australian Army in 1991 and experienced four deployments, had been trekking as part of a fundraising effort by fellow veterans and first responders with the support group Operation Unity SA.

Paul was on the second day of the challenging hike with his 17-year-old son, Aaron, when the tragedy occurred. His partner of 23 years, Amanda, confirmed the devastating news.

“Paul wore many hats - a Father of 5, Partner, Son, Brother, Uncle, mate, Veteran, an even (46th class), sports fan, and a passionate advocate for veterans,” she wrote on Facebook.

“As many of you will know, Paul and Aaron went to Kokoda together last week. Unfortunately on the second day, Paul had what is believed to be a heart attack. Despite all efforts of assistance and of CPR, Paul was airlifted out and it has been confirmed that he had passed away on arrival at the hospital.

She went on to offer thanks for the efforts to revive Paul, and for the safe return of their son, Aaron, before noting that “in true Dusty style, he went out with a bang - doing something that he has always wanted to do … Kokoda.”

Meanwhile, Paul’s daughter Sarah shared her own emotional tribute to social media, writing that her “whole word [was] falling apart.”

“I still don’t want to believe it,” she said. “I still want to believe that Dad will call me and tell me everything will be okay.

“My best friend, my hero, my safety blanket is gone, but I know his memories will live on forever and I will always be meeting people that loved and knew him.”

The Department of Foreign Affairs and Trade released a statement of their own to confirm the news, sharing that they were “providing consular assistance to the family of an Australian man who died in Papua New Guinea. We send our deepest condolences to the family.”

When Operation Unity SA shared the news of Paul’s passing - and Amanda’s original post - the late veteran was met with an outpouring of love, with condolences flowing for his family memories, and his surviving legacy.

“He was a colleague, a mate and brother to many. Dusty was always there for others. I will miss my mate and brother. Till we meet again in Valhalla big man,” wrote one friend. “Lest we forget.”

“RIP Ole mate glad [I] had the opportunity to know you and your caring nature,” wrote another. “Thanks for being a part of our lives you will be sorely missed by all mate.”

“All of our love and condolences to Paul's family. Paul was a true champion and a gentleman, who made the ultimate sacrifice serving others, again, for which there truly is no honour great enough,” shared Diving Veterans & First Responders Program.

And as another friend said, everyone would be “sending love and thoughts to your whole family and everyone Paul touched during his life. Loretta Lynn was more than a great songwriter – she was a spokeswoman for white rural working-class women

Loretta Lynn’s death at the age of 90 marks the end of a remarkable life of achievement in country music.

Her dramatic life story – retold in the 1980 award-winning film “Coal Miner’s Daughter,” based on Lynn’s 1976 biography – made Lynn a household name. She grew up in poverty in a small Kentucky mining town, marrying and starting a family as a teenager before reaching unprecedented heights of commercial success as a recording artist of modern country music.

But as a scholar of gender and country music and author of “Hillbilly Maidens, Okies, and Cowgirls: Women’s Country Music, 1930-1960,” I know that Lynn represented more than just star power and fame in country music – she spoke to the concerns of women, especially white working-class women in rural and suburban America.

Speaking up, singing out

Lynn’s rise in the 1960s took place when country music appeared tied to conservative politics. It was a time when Merle Haggard’s “Okie from Muskogee,” with its attacks on counterculture, marijuana and draft-card burning, became a populist anthem for the country’s cultural conservatives.

In contrast, Lynn’s songwriting continued the legacy of Kitty Wells, Jean Shepard and other women in country music who were willing to speak up about the concerns of American women.

Lynn’s songs defied societal expectations by connecting her musical representations of working-class and rural women to broader social issues affecting women across the U.S.

She aimed for her music to articulate the fears, dreams and anger of women living in a patriarchal society. It railed against those who idealized women’s domestic roles and demonized outspoken feminists.

‘There’s gonna be some changes’

Specifically, for a generation of predominantly white women in the 1960s and 1970s who did not identify as urban or college-educated feminists, Lynn’s music offered candid conversations about their private lives as wives and mothers.

As Lynn stated in her autobiography, her audience recognized her as a “mother and a wife and a daughter, who had feelings just like other women.”

She did this through clever and witty songwriting and lyrical techniques that combined the vernacular of her audience with her resonant voice.

Meanwhile, the song arrangements of Owen Bradley of Decca Records directed Lynn’s musical talents to a broad audience. He combined the edgier sound of honky-tonk instrumentation – electric guitars, pedal steels and fiddles – with the polish of the Nashville sound by including the smooth sounding vocal harmonies of the vocal quartet the Jordanaires, as heard in numerous country, gospel and rock ‘n’ roll recordings.

This provided a sound of strength and conviction to accompany Lynn’s bold and forthright songs as she laid bare the double standards of gender roles.

With her assertive and resonant voice, Lynn, in her 1966 track “Don’t Come Home A Drinkin’ (With Lovin’ on Your Mind),” warns men not to expect women to be waiting at home, sexually available for them after they’d spent the night drinking:

Well, you thought I’d be waitin’ up when you came home last night

You’d been out with all the boys and you ended up half tight

Liquor and love, they just don’t mix

Leave that bottle or me behind

And don’t come home a drinkin’ with lovin’ on your mind

In a similar vein, Lynn, who claimed that her songs about wayward husbands were inspired by her fraught marriage to Oliver “Doolittle” Lynn, confronted the “other woman” in songs such as 1966’s “You Ain’t Woman Enough” and 1968’s “Fist City.”

A lasting legacy

Fully aware that her personalized accounts became political messages for her fan base of women, Lynn co-wrote and recorded “The Pill” in 1975. It was a rare foray into the topic of women’s reproductive rights for country music. In typical fashion, though, Lynn approached the issue from the perspective of a rural working-class woman:

I’m tired of all your crowin’

How you and your hens play

While holdin’ a couple in my arms

Another’s on the way

This chicken’s done tore up her nest

And I’m ready to make a deal

And ya can’t afford to turn it down

‘Cause you know I’ve got the pill

The song’s sexual innuendos about cavorting roosters and hens incorporated the double entendres and humor of early blues and country, while providing a frank discussion about female sexual pleasure. It also addressed the right for women to take control over their bodies and reproduction.

The song came out just two years after the Supreme Court passed Roe v. Wade, granting women the ability to govern their own reproductive health through abortion.

Indeed, Lynn commented on the Supreme Court’s ruling in her autobiography “Personally, I think you should prevent unwanted pregnancy rather than get an abortion. It would be wrong for me. But I’m thinking of all the poor girls who get pregnant when they don’t want to be, and how they should have a choice instead of leaving it up to some politician or doctor who don’t have to raise the baby.”

Her recording “The Pill” spoke to married women who wanted to be able to space out their children and prevent unwanted pregnancies so that they could pursue educational and professional opportunities.

In interviews, Lynn discussed at length how female listeners flocked to her after concerts, relieved to find a public figure with whom they felt comfortable to discuss birth control.

Not everyone was thrilled, though. Male country disc jockeys banned “The Pill” from the airwaves. Nonetheless, the recording became her biggest seller in 1975 and furthered Lynn’s reputation as a spokeswoman for white rural working-class women.

Her music also inspired the women in country music who followed her to further explore issues of gender roles. Lynn’s legacy lives on in the music of female country artists – such as Reba McEntire and Miranda Lambert – who learned from Lynn how to create music that confronts and triumphs over the societal obstacles that women face.

While all of country music will mourn the death of Lynn, it is perhaps her female fans who will feel the loss more acutely. Lynn gave them a social and political voice, and helped make country music a genre relevant to the complexities of women’s lives.

This article originally appeared on The Conversation.

5 minutes with author Patti Miller

In the Over60 “5 Minutes With” series, we ask book writers about their literary habits and preferences. Next up is Patti Miller, who is debuting her novel True Friends - out now!

Patti Miller is an Australian writer and holds a Bachelor in Communications and a Masters in Writing from the University of Technology. She is the author of 10 books and numerous articles and essays that have been published in national newspapers and literary magazines.

In True Friends, a memoir, Patti reflects on the making (and unmaking) of some of her most treasured friendships, the importance of this relationship in our lives, how we choose our friends and how they shape our lives.

Over60 spoke to Patti and asked about where her love of writing came from, and how her experiences helped shape her book True Friends.

1. How did you come up with the idea for True Friends?

To be truthful, it came more from a feeling than an idea. I was boarding a flight in Paris and suddenly saw someone ahead of me on the air-bridge who looked like a friend who had recently ended her friendship with me. It wasn’t her, but I noted the turmoil it caused in me and once I was on the plane I started taking notes about it. I realised that while the endings of romantic relationships were often the subject of novels, memoirs, poems, song and films, the hurt of a friendship ending was rarely written about. By the time I arrived back in Sydney, I knew I had a book to write.

2. What do you look for when making friends?

I think I am drawn to someone’s energy – their engagement with the world, their attention to it. I value self-awareness, openness, thoughtfulness, kindness, interest in and connection to the world. And then if I find out they like books and reading – well that’s a big plus!

3. If you're comfortable sharing, what was the greatest friendship loss that happened to you?

There’s two kinds of losses in friendship – a break-up, and death. A friend has recently died and I have felt that loss deeply as she was formative for me. She shaped my thinking and my life to a certain extent. But I have also lost a friendship due to break up, which was bewildering and which became a central thread in True Friends.

4. What is your advice for your readers who are looking to make new friends?

It’s so different for everyone that I don’t think I can give advice. Generally though, it’s a matter of being open to others. Listening to them, asking questions, rather than talking about yourself too much. That way, you can start connecting to them.

5. What is the importance in knowing oneself and one's friends?

I’m going to quote from True Friends to answer this one: “Friends also share similar versions of the world... Together you and I not only acknowledge the reality of each other, but of our world. It is really there, that stand of gum trees, that mad leader, that childhood we told each other about, it all exists. Because we agree that it does.”

That is, in knowing yourself and others, you re-affirm each other’s version of existence.

6. What book(s) do you think people should read?

Well, clearly “True Friends”!! But also the wonderful set of novels by Elena Ferrante, starting with “My Brilliant Friend”. They are the best novels about a long friendship that I’ve come across. My book is nonfiction, drawing on my own experience, but I suspect Ferrante’s novels also draw on her own experience of friendship.

Olympian Scott Miller arrested in major drug bust

Police claim the arrest of Olympic swimmer Scott Miller is a major coup in dismantling a criminal syndicate they say was intent on causing "death and misery" across regional NSW through the alleged supply of methylamphetamine.

Police arrested two men on Tuesday, including the 45-year-old, following an investigation into the ongoing supply of over $2 million, or at least 4kg, worth of ice.

Police also seized another 2kg of what they believe is a prohibited drug that is undergoing testing, bringing the estimated street value up to $3 million.

Mr Miller was arrested at his waterfront home in Rozelle while another man, Wayne Allan Johnson, was detained at home in Balmain.

Police have now charged Mr Miller with two counts of supplying a commercial quantity of a prohibited drug, dealing with the proceeds of crime and directing a criminal group.

He spent the day being questioned at the police station.

His lawyer Hugh Salter told the court his client would not be applying for bail and asked for the matter to be put off for eight weeks.

Mr Miller’s co-accused, Mr Johnson, was also charged on Tuesday afternoon with supplying a commercial quantity of a prohibited drug and taking part in a criminal group.

They are both expected to face court on April 13.

Police will allege the pair concealed 4kg of the drug known as "ice" inside candles.

It is believed eight candles, each with 500g of ice hidden inside them, were intercepted in a vehicle on its way to Albury in regional NSW.

“The ice (inside the candles) is of very high purity ... it was moulded inside the glass in each candle,” Drugs and Firearms Squad commander John Watson said.

The most important letter you'll read this year

Perth woman and Invictus Games competitor Ruth Hunt has passed away just days after penning an open letter to her past self.

Hunt was only 34 years old when she was diagnosed with stage three breast cancer.

Following multiple surgeries and 12 months of chemotherapy she went into remission, but unfortunately, her cancer returned.

Despite her illness, Ruth joined the ADF Adaptive Sports Program and competed in the United States Air Force Warrior Games trials in Las Vegas just two weeks after finishing chemotherapy.

A talented swimmer and rower, she won five gold medals.

Hunt was expecting an Australian Sports Medal for her Invictus Games efforts but she tragically passed away before getting her hands on the award.

Her co-captain Nicole Bradley confirmed the news on Monday.

“Two years on, we’ve received the sad news that one of our teammates passed away overnight,” she told 2GB.

“It’s really sad that Ruth never got to see this medal.

“We’re hoping that it will still come about so that her family can still receive it in her honour, and then we can all pay our respects in that way as well.”

Ruth leaves behind her loving family and her cherished husband Lieutenant Colonel Andy Love.

One of Ruth’s final wishes was to publish a letter to her pre-cancer self to remind everyone what is important about living.

This is that letter.

Rest in peace, Ruth.

Ruth’s letter

Dear Me,

You don’t know this yet but you’re going to have a rough few years in the future - far earlier than you might expect.

Don’t worry – as rough as it gets, it turns out you’re a lot tougher than you thought and you will have a lot more support than you could imagine.

Getting cancer at 34 will teach you a few lessons.

Along the way, you’ll have amazing experiences, so don’t fret it’s not all doom and gloom.

You will get to meet Prince Harry; you will compete for Australia; you will become a lawyer and an Army officer; and you will travel the world.

You will find your human (he’s lovely!) and the friends you have in your early twenties, you will still have in your late thirties.

However, despite all these wonderful things, at age 34 you will unfortunately be diagnosed with stage 3 triple negative breast cancer. And, by the time you’re 37, you’ll be diagnosed with stage 4 terminal breast cancer.

Cancer sucks.

The first time around it’s not the end of the world. The second time around is a more difficult pill to swallow but, again, it’s not the end of the actual world.

It will, however, be the end of you in this world - somewhat prematurely.

Cancer will teach you that you can still train, go out, dance, sing, cook, love, work, be a sister, girlfriend and friend.

The main lessons it taught me are listed below (because what lawyer doesn’t love a good list.

Lesson one – Ask for help

Mum always tells you the story of how you were playing with pieces of cloth as a one year old and that you were getting very frustrated because the cloth wasn’t doing what you wanted but you wouldn’t let anyone help.

There’s also a great photo of you attempting to dress yourself as a two-year-old and failing miserably - again refusing help.

Getting cancer will teach you that, not only is it ok to ask for help, but it will actually make life a lot easier.

Lesson two – Family is so important

In your twenties you will be so busy working and training that family gets a little too left behind at times.

You move to the Eastern States and you are not very good at picking up the phone. You send birthday presents but they are usually late and when you do come home it’s for a whirlwind tour.

Cancer will teach you that family is everything. They will be the ones sitting next to you on the chemo ward, flying across Australia just to be with you, sending you care packages and flowers. It will not be workmates.

On top of this, you will find people who aren’t blood related - but they might as well be.

They are the friends who call, even after there’s bad news; there will be friends who support you and love you and accept you, even if you’re a very different person from the one they met.

Treasure your family and spend as much time with them as you can.

Lesson three – Stress less

I promise you, you won’t be sweating on the small stuff when you are facing the end of your life.

In the grand scheme of things, missing a day of work because you have a cold is fine. It doesn’t matter that you got 69% in an essay instead of 90%, in the long run no-one looks at your marks.

Working Christmas Eve instead of spending it with family is a really terrible idea. (You don’t even get paid more on Christmas Eve!).

Don’t worry if you’re a tiny bit late - no-one will remember. Same as no-one will remember if you wear the same dress to two functions with the same people.

Lesson four – Dogs are awesome

You will make the magical and terrible mistake of buying a puppy two weeks after getting a double mastectomy.

Magical because Dougal is the greatest character ever.

Terrible because you will quickly find out that lifting puppies is difficult post-surgery.

But you will learn that sometimes just cuddling your dog is one of life’s great joys and that, post chemo, having a nice warm body lie with you is just what you need.

You will get your own dog one day. He will be all yours - weird and lovely and he will worship the ground you walk on. He’ll be your only dog ever and he will be wonderful.

Lesson five – It’s ok to say no

You don’t know it yet but you are prone to saying yes to everything.

This is one of the biggest lessons cancer will teach you.

You will learn that you do not have to always say yes. Often, there are other people who can do the work.

You will learn that if someone gets a touch cranky when you say no, that’s not actually your problem, but theirs.

Cancer will teach you that a lot of people have been taking advantage of your generosity and kindness for a long time. The earlier you learn to say no, the better.

Lesson six – Travel

Travel as far and as wide as you can. Don’t worry about taking time off work - it will always be there when you get home.

As a wide-eyed, borderline fan girl law student, you and your friends will be dumbfounded when the Hon. Justice Michael Kirby tells you how he drove across China and Russia in a Kombi when he was a young lawyer. At the time, you will be so busy applying for law internships that you can’t fathom the idea of taking that much time away from your floundering career.

Do it. There are so many places for you to explore. Go to Africa while you can and yes, Europe is amazing but there are a lot of different places to explore beyond Europe.

There are so many places to go but, by the time you’re 34, cancer means you won’t be able to travel anymore.

These are the lessons you will learn.

You will wish that you had known them before getting cancer.

Ruth Bader Ginsburg forged a new place for women in the law and society

Justice Ruth Bader Ginsburg’s death has generated an outpouring of grief around the globe. Part of this grief reflects her unparalleled status as a feminist icon and pioneer for women in the legal profession and beyond.

There is already considerable interest in what her departure means for the future of the US Supreme Court, and indeed, the wider political landscape. But to understand that, we must reflect on her legacy.

In 1956, Ginsburg enrolled in Harvard Law School, one of only nine women in her year alongside about 500 men. Reflecting the prevailing mindset of the time, which regarded the study and practise of law as the proper domain of men, the Harvard dean, Erwin Griswold, asked each of the nine women how they could justify taking the place of a man.

Ginsburg’s answer, that she wanted to better understand her husband Marty’s career as a lawyer (he was the year ahead of her at Harvard), belies the reality of the enormous contribution she would make to public life in the subsequent six decades.

The number nine would come to be significant in marking her success in a profession traditionally dominated by men. In 1993, she took her place on the nine-judge Supreme Court as the second woman appointed in its history.

In more recent years, in response to questions about when there will be “enough” women judges, Ginsburg replied there would enough when there were nine women on the Supreme Court. Acknowledging that people are shocked by this response, Ginsburg famously countered “there’s been nine men, and nobody’s ever raised a question about that.”

This exchange points to just how ingrained the idea that judging is men’s work had become.

A formidable mind

Long before President Bill Clinton resolved to nominate Ginsburg to the Supreme Court, Ginsburg had established a reputation as an academic (she was the second woman to teach law full-time at Rutgers University and the first woman to become a tenured professor at Columbia Law School). She was also known as a feminist litigator, leading the American Civil Liberties Union’s campaign for gender equality.

Ginsburg’s nomination to the Supreme Court was an uncontroversial appointment. She was regarded as a restrained moderate and was confirmed by the Senate 96 votes to three.

Although there were some concerns she was a “radical doctrinaire feminist”, her credentials were bolstered by her record on the United States Court of Appeals for the District of Columbia Circuit (she was appointed by President Jimmy Carter in 1980).

Ginsburg had spent the 1970s pursuing a litigation strategy to secure woman’s equality — although she would describe her approach in broader terms as the “constitutional principle of equal citizenship stature of men and women.”

In a series of cases, she sought to establish

sex, like race, is a visible, immutable characteristic bearing no necessary relationship to ability.

By extension, she argued, legal classifications on the basis of sex should be subject to the “strict scrutiny” required in cases where there were distinctions or classifications on the basis of race. To put it more bluntly, pigeon-holing on the basis of sex should be unconstitutional. The nub of her argument, whether acting for men or women plaintiffs, was that treating men and women differently under the law helped to “keep woman in her place, a place inferior to that occupied by men in our society.”

Outside the court — and inside, too

Feminist theorists have sometimes expressed reservations about the extent to which a legal system designed by men to the exclusion of women can ever be fully appropriated to achieve equality for women.

While some feminists have seen much promise in the possibility for law reform, others have been more circumspect. This tension is reflected in the two-pronged strategy proposed by Professor Mari Matsuda — that there are times to “stand outside the courtroom” and there are times to “stand inside the courtroom”.

Ginsburg’s legacy in life and law reflects the latter approach. Her faith in the law is reflected in her approach to stand inside the courtroom (literally as a litigator and a judge) to transform existing legal categories. In this way, her approach was reconstructive rather than radical (which is not say that some of her thinking wasn’t radical for its time).

Ginsburg sought to reconstruct sex roles and emphasised men and women alike were diminished by stereotypes based on sex.

Importantly, Ginsburg did not simply pursue formal equality (the idea that equality will be achieved by treating everyone the same). Rather, she advocated for affirmative action as a principle of equality of opportunity.

She favoured incremental rather than radical change, reflecting a view that such an approach would minimise the potential for backlash. Her critique of the strategy adopted in the landmark 1973 case Roe v Wade (the case upon which US reproductive rights are based), and her departure from the feminist orthodoxy on this point, reflected her preference for incrementalism.

Legacy on the bench

Ginsburg’s jurisprudential contributions on the Supreme Court continued the legacy she began in the 1970s.

One of her most significant majority opinions in 1996 required the Virginia Military Institute to admit women. Importantly, this was because it had not been able to provide “exceedingly persuasive justification” for making distinctions on the basis of sex. Although this standard fell short of the “strict scrutiny test” required in cases involving classifications on the basis of race, it nonetheless entrenched an important equality principle.

But it was perhaps her judicial dissents, sometimes delivered blisteringly in the years where she was the lone woman on the bench (prior to President Barack Obama’s appointment of Sonia Sotomayor in 2009 and Elena Kagan in 2010), that seem to have really captured the wider public imagination and catapulted her into the zeitgeist.

It was in the wake of her 2013 dissent in a case about the Voting Rights Act that she reached the status of a global feminist icon. A Tumblr account was established in her honour, giving her the nickname “Notorious RBG” (a title drawn from the rapper Biggie Smalls’ nickname Notorious B.I.G). A 2018 documentary RBG chronicled her legacy and status as a cultural icon, and a 2018 motion picture On the Basis of Sex depicted her early life and cases.

Ginsburg’s celebrity certainly expanded during her time on the court — but this is not to say to it has been without controversy or critique, even from more liberal or progressive sources.

She has been criticised for her decisions (for example, a particular decision about Native Americans and sovereignty), for her comments about race and national anthem protests, and for being too partisan — particularly in her criticism of President Donald Trump. (She called him a “faker” and later apologised.)

A great legacy

Did Ginsburg’s feminism or celebrity undermine her legitimacy as a judge? Questions of judicial legacy and legitimacy are complex and inevitably shaped by institutional, political and legal norms. Importantly, her contributions as a lawyer and a judge have done much to demonstrate how legal rules and approaches previously regarded as neutral and objective in reality reflected a masculine view of the world.

Over 25 years ago, Ginsburg expressed her aspiration that women would be appointed to the Supreme Court with increased regularity: “Indeed, in my lifetime, I expect to see three, four, perhaps even more women on the High Court Bench, women not shaped from the same mold but of different complexions. Yes, there are miles in front, but what distance we have travelled from the day President Thomas Jefferson told his secretary of state: ‘The appointment of women to [public] office is an innovation for which the public is not prepared.”

That Ginsburg came to share the Supreme Court with two women, Kagan and Sotomayor, must have given her some hope that women’s access to places “where decisions are being made” was at least tentatively secure, even if hard-won feminist gains sometimes felt tenuous at best.

Ginsburg was a trailblazer in every aspect of her life and career. The women who follow her benefit from a legacy that powerfully re-imagined what it means to be a lawyer and a judge in a legal system that had been made in men’s image.

Written by KCasey McLoughlin.
